Terms of Service
The agreement between you and Hospry — what you can expect from us, and what we expect from you. In plain language.
Last updated: 9 June 2026
TL;DR
Use Hospry for running your kitchen — don't abuse it, break the law with it, or try to hack it.
Your data is yours. You're responsible for what your team enters and for meeting your own food-safety record-keeping duties.
Hospry is a tool, not a guarantee of compliance — AI suggestions and calculations can be wrong, so apply professional judgement.
You can cancel any time. We provide the service “as is” and our liability is limited, as set out below.
01This agreement
These Terms of Service (the “Terms”) are a contract between you and Hospry ([eenmanszaak — vul handelsnaam in / fill in trading name]) (“Hospry”, “we”, “us”). They cover your use of the Hospry website, apps and services (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
If you're agreeing on behalf of a restaurant or business, you confirm you're authorised to bind that business, and “you” means that business.
02Accounts, roles and staff
- You must give accurate account details and keep them up to date.
- You're responsible for keeping your login secure and for everything done under your account.
- Hospry uses roles (owner, chef, staff) and short staff PINs. PINs identify who did what — they are not secure passwords, and you decide who gets one.
- You're responsible for making sure the people you add are allowed to use the Service and understand how their data is handled.
- You must be at least 18 and able to enter a contract.
03Acceptable use
Please use Hospry responsibly. You agree not to:
- Break the law, or use the Service for anything illegal or harmful.
- Upload content you don't have the right to use, or that infringes others' rights.
- Try to hack, overload, reverse-engineer or disrupt the Service or its security.
- Resell or sublicense the Service without our written permission.
- Use the Service to build a competing product, or scrape it at scale.
If you seriously or repeatedly break these rules, we may suspend or close your account — we'll give notice where we reasonably can.
04Your data and content
Your recipes, HACCP logs, stock counts and other content stay yours. You give us the limited permission we need to host, process and display that content so the Service can work — nothing more.
How we handle personal data is set out in our Privacy Policy, which forms part of these Terms.
Your food-safety responsibility: Hospry helps you record and check temperatures and produce HACCP documentation, but you remain responsible for your kitchen's actual food safety, for the accuracy of what's logged, and for keeping the records the law requires (for example for an NVWA inspection). Hospry is a tool to help — it is not a substitute for your own HACCP plan, training or professional judgement.
05AI features
Hospry includes AI features that make suggestions — for understanding your kitchen, ordering and reducing waste. AI output is generated automatically and can be incomplete or wrong.
- Treat AI suggestions as input, not instructions — always apply your own judgement.
- Never rely on AI alone for anything affecting food safety or legal compliance.
- We don't warrant that AI output is accurate, complete or fit for a particular purpose.
06Availability and changes
- We work hard to keep Hospry available, but we don't promise it will be uninterrupted or error-free.
- We may need to perform maintenance, update features, or occasionally change or remove parts of the Service.
- If we make a change that materially reduces a core feature you pay for, we'll give you reasonable notice.
07Plans and payment
- Some features are free; paid plans (when available) are billed in advance on the cycle shown at checkout.
- Prices may include or exclude VAT (BTW) as indicated; you're responsible for any taxes that apply to you.
- Unless the law says otherwise, fees already paid are non-refundable, but you keep access until the end of the period you paid for.
- If a payment fails, we may suspend paid features until it's resolved.
Paid plans and billing aren't live yet. When they launch, the specific pricing and payment terms shown at checkout will apply alongside these Terms.
08Our intellectual property
Hospry, its software, design, brand and logo are owned by us and protected by law. These Terms give you a limited, non-exclusive, non-transferable right to use the Service — they don't transfer any ownership to you.
09“As is” — no warranties
We provide the Service with reasonable care and skill, but “as is” and “as available”. To the extent the law allows, we don't give other warranties — including that the Service will meet every need, be error-free, or that its calculations or AI output will be accurate for your specific situation. Nothing here limits rights you have that can't be limited by law (including any mandatory consumer rights).
10Limitation of liability
To the maximum extent the law allows:
- We're not liable for indirect or consequential loss — for example lost profits, lost data, business interruption, or fines and penalties arising from your own compliance obligations.
- Our total liability to you for any claim is limited to the fees you paid us for the Service in the 12 months before the claim (or €100 if the Service was free).
- We don't exclude or limit liability for anything that can't legally be excluded — such as fraud, or death or personal injury caused by our negligence.
11Ending the agreement
- You can stop using Hospry and close your account at any time.
- We may suspend or end your access if you seriously breach these Terms, or if we must do so for legal or security reasons.
- On closure, we'll delete or anonymise your data as described in the Privacy Policy. Export anything you want to keep first.
- Terms that by their nature should survive (e.g. liability, intellectual property) continue after the agreement ends.
12Changes to these Terms
We may update these Terms from time to time. If a change is material, we'll update the date above and let you know in the app or by email. Continuing to use Hospry after a change means you accept the updated Terms.
13Governing law
These Terms are governed by Dutch law. Disputes will be brought before the competent court in the Netherlands, unless mandatory law (for example consumer law) gives you the right to a different court. If any part of these Terms is found invalid, the rest stays in force.
